DIY Super Funds are established by a trust deed. The structure of the Super fund will determine the contents of the trust deed. Purpose of the trust deed of a DIY Super Fund is as follows:
- to define the rights of members to benefits and their other rights;
- to define the powers, rights and obligations of trustees;
- to provide provisions for the administration of the plan such as accounts;
- to specify the procedures for the termination and/or winding up of the fund
- to make provision for contributions to be made to the fund;
- to ensure that the fund complies with the relevant legislation; and
- specify when benefits are payable to members.
